Please do not hesitate to contact us if any
point requires clarification. 1. RESTRICTIONS Voucher recipients ("participants") must be at least 14 years old when their trial lesson takes place. They should be between 4'6" and 6'4" (137cm and 193cm) in height, and have a maximum weight of 17 stone (108kg). Participants
will need to be agile enough to get in and out of the aircraft and must
be medically fit for flying. If participants have any doubts about their
medical fitness, they should consult their doctor. Please bear in mind
that no one should fly if suffering from a heavy cold or flu. Participants
should seek advice from their doctor if they have previously suffered
a heart condition or other medical complaint (eg. neck or back problems)
that may be aggravated by flying in a light aircraft. It is strongly recommended
that you do not participate in a trial lesson whilst pregnant. All flights will be carried out in accordance with the Air Navigation Order. The instructor will act as pilot-in-command and has legal authority over the conduct of the flight. Participants will be expected to take part in a safety briefing and must comply with any instruction or request made by the instructor. If a participant acts in a manner that the instructor, at his sole discretion, considers dangerous, the flight will be terminated immediately without refund. Skylark Aviation Ltd will not allow a flight to be conducted if the instructor believes that a participant is under the influence of alcohol or drugs. Skylark Aviation's aircraft are maintained to a very high standard and comply with all UK Civil Aviation Authority requirements for public transport operations. The Company's insurance covers passengers and third-party liability to a maximum of £2,000,000. Whilst every possible measure is taken to maximise safety, all types of flying involve a small element of personal risk. In purchasing a trial lesson voucher, you accept the existence of this risk. Please note that life insurance policies vary in their coverage, and some may exclude flight in light aircraft. If in doubt, participants should check with their insurer. 3. ORDERING AND BOOKING Vouchers are dispatched by first class post and are normally delivered within two working days of order placement. At certain times of year, especially Christmas, delivery is likely to take longer. If you require guaranteed delivery by a certain date, please contact us before placing your order. Skylark Aviation Ltd is a non VAT-registered company and no VAT is chargeable on purchases. Customers placing orders online will receive an electronic invoice. If you wish to pay for your purchase by cheque, please inform us if an invoice is required. In the event of a credit card transaction dispute or the failure of a cheque to clear, the voucher will be invalidated until such time that payment is received in full. All vouchers are valid for 12 months from date of issue, but the period of validity may be increased by an additional 6 months from date of expiry on payment of 50% of the current equivalent lesson price. Vouchers may be transferred to another name subject to a £10.00 administration fee. Participants should contact us at least two weeks before they want to fly. Whilst we will do everything we can to arrange the flight for a particular date, instructor and aircraft availability may preclude this. The stated duration of trial lessons includes five minutes for taxiing. 4. CANCELLATION Short notice cancellation may become necessary because of unsuitable weather conditions, aircraft serviceability, instructor availability or other unforeseen circumstances beyond Skylark Aviation Ltd's control. In this event, an alternative date will be arranged with the participant. Vouchers will be honoured if this means that the new date is outwith the 12-month validity period, provided that the original booking was made before the voucher expired. Skylark Aviation Ltd will not be liable for any inconvenience, consequential loss or expense incurred as a result of such a cancellation. Should participants be unable to fly at a pre-arranged date and time, they are required to give at least 24 hours' notice of cancellation. A "failure to show" charge of £20.00 will apply to bookings cancelled with less than 24 hours' notice. 5. REFUNDS AND COMPLAINTS Any complaints should be addressed with the instructor on the day of the trial lesson. If this is not possible, please inform us in writing by sending an email to info@skylarkaviation.co.uk. Vouchers are non-refundable, although Skylark Aviation Ltd may elect to provide a refund under certain circumstances at its discretion, subject to an administration fee. Refunds will not be given in the event that a participant does not meet the restrictions for flight as detailed in section 1, or if the instructor decides to terminate the flight on the grounds of safety as detailed in section 2. Note that refunds can only be made to the purchaser, and will not be made to the participant or any third party. 6. DATA PROTECTION By purchasing a trial lesson voucher, you authorise Skylark Aviation Ltd to store the information provided by you in relation to the purchase, either in paper or electronic form. Your personal details will be kept confidential, and will not be used for promotional purposes nor passed to any third party. The participant will be required to provide additional personal information in relation to the flight, which will be passed to Prestwick Flying Club Ltd as required by the Civil Aviation Authority. 7. JURISDICTION Skylark Aviation
Ltd is a Scottish registered company and any contract between the company
and the purchaser or participant, either written or implied, shall be
governed by the Laws of Scotland.
